Since August 5, 2026, USCIS policy PA-2026-05 lets an officer deny a filing that is missing required initial evidence, or that doesn't establish eligibility, without sending an RFE or a NOID first. RFEs still exist, but you can't count on one. This page is what that means for how a packet gets built.

What changed

  • Officers may deny without first issuing an RFE or NOID when required initial evidence is missing. (8 CFR 103.2(b)(8)(ii))
  • Twelve weeks is now the maximum RFE response period, not the default.
  • A partial RFE response is treated as a request for a decision on the record.
  • It applies to benefit requests generally, including cases pending on August 5, 2026.

Two things that can't happen to a packet built here

One

Two forms can't disagree.

In most case management software each form holds its own copy. The I-485 has a box with 123 Main St. The I-864 has a separate box with its own copy. Two copies exist. If the paralegal types Street in one and St. in another, the forms now disagree, and nothing stops that except a human check. The same thing happens with a wage: $98,000 on the LCA beside $89,000 on the I-129 reads to USCIS as an inconsistency.

I-485

123 Main Street

I-864

123 Main St.

Two copies, quietly diverging.

Here there is one source that populates every form at once. Think of a spreadsheet: the address lives in cell A1, and every form writes =A1. Change the fact once and every form updates together. No form keeps its own copy of anything, so the RFEs that come from two forms disagreeing become impossible.

Fact: 123 Main St
  • I-130=A1
  • I-485=A1
  • I-864=A1
  • I-765=A1
  • I-131=A1

Two

Required evidence can't be missing.

The packet can't be marked ready to file until every required item on the checklist is in it. Your paralegal clears the readiness list. Your attorney signs and releases. Until both have happened, nothing leaves.

The honest RFE context

H-1B RFE rates are policy-volatile: completions with an RFE ran about 40.2% in FY2019 and about 8% overall, 13% on initial-employment petitions, in FY2024, per USCIS's own reporting (33,393 RFEs across 407,625 completions). The number moves with administrations and guidance, and adjudication is increasingly a machine-first read that cross-references fields. You can't control the policy weather, so control the one thing you can: a packet that never contradicts itself and never leaves incomplete.

Scope, read this part

The RFEs that come from two forms disagreeing become impossible. Other RFEs, the ones about the merits, the law, or an officer's judgment, are still your work. We don't prevent RFEs. We remove one class of them and we won't let a packet leave incomplete.

Try to make two forms disagree.
