For H-1B, PERM and L-1 practices

Working out the SOC code and wage level by hand on every case.

Then keying the same wage into the LCA, the I-129 and the support letter. Then retyping the whole file when the client moves to the I-140. Cap season eats the spring and nothing else moves.

How it usually goes

It's March. Fifty petitions. Each one is the LCA, the I-129, two support letters and the Public Access File, and all five have to state one wage, one SOC code, one worksite. On one of them the LCA says $98,000 and the I-129 says $89,000, because two people typed it on two different days. That's what an RFE looks like before it's an RFE.

The failure mode

Two people typed one wage on two different days. USCIS reads the result as a packet that disagrees with itself.

On the LCA$98,000
On the I-129$89,000

reads to USCIS as an inconsistency.

One fact$98,000

In ParaLeagle the wage goes in once and lands in the LCA, the I-129 and the support letter. They can't disagree.

What we built for this work

  • Employer and beneficiary intake in the same system as the petition, with the questions that are actually required marked as required.
  • The SOC code and the wage level for the actual worksite get proposed for you. You accept or overrule, and your decision outranks the software permanently.
  • The wage goes in once and lands in the LCA, the I-129 and the support letter.
  • H-1B across 26 case types: cap and cap-exempt initials, transfers, extensions, amendments, concurrent filings, and change of status from F-1, B-2, L-1, J-2, H-4 and L-2. H-4 dependents and the H-4 EAD on the same facts.
  • The Public Access File builds itself.
  • PERM straight through, not stopping at the petition: the ETA-9141 prevailing wage, recruitment tracking with dated evidence, the audit file and the ETA-9089. The wage DOL certifies is the wage USCIS reads.
  • Your caseworker still enters the ETA-9141 and the ETA-9089 into FLAG, because that's how DOL works. Our browser extension checks what was typed into FLAG against the fact record and flags any difference before it's submitted. It never fills the portal for you.
  • The facts carry from the H-1B into the I-140. The same client doesn't show up twice in the system.
  • L-1A and L-1B on the same record as the H-1B.
  • The education evaluation is on the checklist and tracked, not chased.
  • Before an H-1B files, an RFE risk read: a level (low, medium, high), the likely RFE topics, wage benchmarks, and comparable AAO non-precedent decisions from our own corpus, with a plain note on where the data is thin. Decision support, never an outcome prediction.
  • A packet can't be marked ready to file with a required piece missing. Filed through your myUSCIS legal representative account or shipped on the FedEx calendar after your attorney signs. The receipt notice, case status and any RFE land back on the case, and the H-1B renewal alerts fire at 180, 120, 60 and 0 days.

What you get

  • Cap season on one record. Fifty petitions at about 6.6 hours of assembly each is about 330 hours, eight work-weeks of one paralegal's year, and most of it is retyping.model estimate
  • One wage, one SOC code, one worksite, everywhere.
  • The I-140 starts from the H-1B file instead of an empty folder.
  • PERM recruitment in a tracked checklist, not a spreadsheet nobody fully trusts.
  • Every receipt notice on the case the day it arrives.

What stops going wrong

  • $98,000 on the LCA next to $89,000 on the I-129.
  • The SOC code worked out by hand at 11pm in March.
  • Recruitment dates that don't match the audit file.
  • The client's facts retyped at the I-140 stage.
  • The extension nobody started until the I-94 was 30 days out.

What stays yours

The system proposes the SOC code and the wage level. You accept it or overrule it, and your decision outranks the software permanently. Every letter is a draft until your attorney signs it. The G-28 is in every packet. Nothing is filed until your attorney signs and releases it.
