For O-1, EB-1 and NIW practices

Spending more time gathering evidence than writing the petition.

That's what we kept hearing from attorneys who do extraordinary ability work. The research on one petition eats a week you can't fully bill. Every new petition starts the evidence hunt from scratch. And you're the one deciding what counts as evidence, every single time.

How it usually goes

The client sends a CV, a folder of PDFs and a link to their citation page. Someone on your team spends the week working out which of the eight O-1A criteria you can actually claim, chasing the award letters and the citation report, drafting six recommendation letters that must not sound like the same person, and building the exhibit list by hand. The final-merits section, where most denials happen, gets written last, when everyone's tired. And if a required piece is missing, since August 5 USCIS can deny without asking for it.

What we built for this work

  • Intake runs in the same system as the petition. The client's questionnaire and uploads build the record the whole case runs on.
  • It reads the CV, the awards, the publications, the contracts and prior filings, and fills in the criteria map: eight O-1A criteria, six O-1B, ten EB-1A, the six EB-1B criteria with two required, and the three Dhanasar prongs. Each document is matched to the criterion it proves.
  • A live list of what's still missing, per criterion, that updates as documents come in.
  • Five to eight recommendation letters drafted in different voices from concrete facts, with independent recommenders flagged, so the independence question doesn't come up.
  • The cover letter cites every exhibit by tab, and the exhibit index builds itself.
  • The final-merits section (the Kazarian second step) drafts to your template, for your sign-off. The Dhanasar sections do the same on the NIW.
  • O-1 consultation: the right union or peer group for the field, and the request tracked until the answer comes back.
  • EB-1C runs on the intake the L-1A already uses, with the managerial-capacity sign-off as an attorney gate.
  • The pre-filing check won't mark a packet ready with a required piece missing.
  • Concurrent I-485, I-765 and I-131 from the same facts when the priority date is current, with the Visa Bulletin read every month.
  • Filed through your myUSCIS legal representative account or shipped on the FedEx calendar after your attorney signs. The receipt notice, case status and any RFE land back on the case.
  • When the same client comes back for the EB-1A, the criteria map and the evidence file built for the O-1 are still there. If you also ran their H-1B, those facts carry into the I-140 without being retyped.

What you get

  • The week of research becomes a day of checking what the system found and deciding what to claim.
  • Every claimed criterion shows its evidence before you sign.
  • Letters that read as six different people, because they were drafted that way.
  • A packet that can't be marked ready to file until it's complete.
  • One system from the first call to the approval notice, with your paralegal checking each stage.

What stops going wrong

  • A thin first filing. Since August 5, that can be a denial, not an RFE.
  • Eight letters that sound like the same person.
  • An exhibit list that doesn't match the cover letter.
  • The consultation request nobody tracked.
  • The evidence hunt starting over when the O-1 client comes back for the EB-1A.
  • A premium processing RFE that stops the clock you paid for.

What stays yours

You decide which criteria to pursue. You sign off on the final-merits section, the Dhanasar sections, every recommendation letter, the consulting body and the pre-filing check. The software can't skip any of them. Every output is a draft until a person approves it. Nothing is filed until your attorney signs and releases it.
